Terms of Service

Last updated: 22 August 2026. Drafted with reference to standard UK SaaS/EdTech contracting practice; not a substitute for bespoke legal advice for your school's specific circumstances.

1. Who we are and what this covers

Marc Jones, trading as Emeejay Assess ("we", "us", "the Provider") – a UK sole trader – provides a phonics, maths and wider curriculum assessment tracking service for primary schools, available at emeejay.com (the "Service"). These Terms of Service ("Terms") govern use of the Service by any school, member of school staff, or other organisation that creates an account ("you", "the School").

By creating an account, starting a free trial, or subscribing to the Service, you agree to these Terms on behalf of the School. If you don't have authority to agree to these Terms on the School's behalf, please ask a colleague who does (for example, the School's headteacher or business manager) to review and accept them.

Our Privacy Policy and (once signed) our Data Processing Agreement form part of these Terms and explain how personal data is handled.

2. The Service

Emeejay Assess lets school staff record and track pupil assessment results across phonics, maths, times tables, English, and other subjects; run live in-class or remote assessment sessions; view analytics and gap analysis; set targets; and generate parent-ready progress reports.

The content library – questions, checks, and topics – is continually expanding and improving. We don't guarantee that every topic, tier, or question is available or fully polished at any given time; staff can flag anything that looks wrong using the in-app "Report this question" links.

4. Free trial

New schools can try the Service free for 14 days. To start a trial, the School's account owner adds a payment card via our payment provider, Stripe, when creating the school account – no payment is taken at this point. If the card step isn't completed, the account stays inactive and can't be used until it is.

The trial automatically converts into a paid annual subscription at the end of the 14 days, and the card on file is charged the then-current annual fee, unless the School cancels before the trial ends (see section 5).

7. Your content and pupil data

As between us and the School, the School owns the pupil and assessment data it enters into the Service ("School Content"). We process that data only as your data processor, under the terms of our Data Processing Agreement and Privacy Policy – we don't claim ownership of it, and we don't use it to train AI models or for any purpose beyond providing and improving the Service to your school.

If a member of staff submits a custom assessment, a suggested question, or reports an issue with a question, you agree that we may review, adapt, and (at our discretion) incorporate that suggestion into the shared content library used by all schools, with any personally identifying details about your school removed. The custom assessment itself remains usable by your school regardless of whether we do this.

8. Our intellectual property

The Service – including its software, design, question content, and the Emeejay Assess name and logo – is owned by us or our licensors and is protected by copyright and other intellectual property laws. Subscribing to the Service gives the School a licence to use it for its own pupils and staff; it doesn't transfer ownership of the Service or its content to the School.

9. Availability and support

We aim to keep the Service available and working correctly, and will try to give notice of planned maintenance where practical. As a sole-trader product, we don't offer a formal, contractually guaranteed uptime service level agreement (SLA) or 24/7 support.

As an informal aim rather than a guarantee, we try to respond to reported issues within 24 hours. This isn't a contractual commitment – response times may occasionally be longer, for example due to holiday or illness – but it reflects what you can typically expect.

We strongly recommend schools regularly export their results as CSV and keep a copy somewhere safe (for example, the school's own Teams, SharePoint, or OneDrive), as the in-app banner also reminds you – in case data is ever lost or accidentally deleted.

11. Liability

To the fullest extent permitted by law, we are not liable for any indirect, special, or consequential loss (for example, loss of profits, data, or goodwill) arising from your use of the Service. Our total liability to a School for any claim arising from these Terms, however caused, is capped at the total fees paid by that School in the 12 months before the claim arose.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can't legally be excluded or limited.

This limitation reflects standard practice for a small SaaS provider of this kind. Larger multi-academy trusts with their own procurement terms and greater bargaining power are welcome to raise liability terms as part of onboarding a group-wide agreement.

12. Changes to these Terms

We may update these Terms from time to time as the Service changes. We'll update the "last updated" date above and, for material changes, aim to let schools know directly (for example, by email).

13. Governing law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction over any dispute arising from them. This applies to every School regardless of where in the UK it is based, consistent with standard commercial practice for UK-wide software agreements between businesses (as opposed to consumer contracts, where different rules can apply). A School based in Scotland or Northern Ireland that would prefer a different jurisdiction clause is welcome to raise this with us before signing up.
